Terms of Use

Modifications. Custom Media may modify the GoConnect Terms of Use, or any part thereof at any time. These modifications, additions or deletions will be effective immediately upon posting. By using the site, you accept and agree to such modifications.

Changes to website. Custom Media may change or discontinue any service, feature, or content of the GoConnect site at any time without any obligation or notice to you.

Registration. Custom Media will use the information you provide during online registration in accordance with the GoConnect Privacy Policy. By registering, you declare that all information that you provide on the registration form is accurate. You acknowledge and agree that Custom Media may rely on your username to identify you. You are responsible for protecting the confidentiality of your account access details, and all use of your account, regardless of whether you authorized such access or use, and for ensuring that all use of your account complies fully with the provisions of these Terms of Use.

User content and conduct. User-generated content covers but is not limited to comments, articles, advertisements, videos, photos, and other materials. By submitting user content, you represent that you are of legal age, and that if you are under 18, you have obtained the consent of your parent or legal guardian to enter into these Terms of Use to submit content to the site and fulfill the obligations in these Terms of Use.

Custom Media does not vouch for the accuracy or credibility of any user content, and does not take any responsibility or assume any liability for any actions or inactions you may take as a result of reading or using user content posted on the GoConnect site.

• You agree not to upload, post or transmit content protected by copyright, trademark, trade secret, right of publicity, or other proprietary right without the express permission of the owner of such copyright, trademark, trade secret, right of publicity, or other proprietary right. You are solely responsible for ensuring that your user content is not protected by copyright, trademark, trade secret, right of publicity, or other proprietary right. You shall be solely liable for any damage resulting from any infringement of copyrights, trademarks, trade secrets, rights of publicity, or other proprietary rights or any other harm resulting from such a submission. Custom Media, at its sole discretion, may also bar you from submitting user content if you have violated intellectual property or other rights.
  
• You agree not to upload, post, or transmit content that contains unsolicited or unauthorized advertising or promotional materials or content that would promote, facilitate, or encourage illegal activity based on Japanese law.
  
• You represent that you have the consent of each and every identifiable person in any of your submissions to GoConnect.
  
• You agree not to reproduce, duplicate, copy, sell, resell, or exploit for any commercial purpose any portion of the site, use of the site, or access to the site.
  
• You agree not to use any technology, service, automated system, or third party to post user content on your behalf.

Custom Media has the sole discretion and reserves the right to delete comments or user content that it deems offensive or in violation of these Terms of Use. It also reserves the right to terminate your account for any reason. Custom Media also reserves the right to monitor, screen, edit, or remove user content posted or uploaded to the site to comply with these Terms of Use, Japanese law, or any authorized government request. 

License to user content. By submitting user content to the site, you grant Custom Media the royalty-free, perpetual, irrevocable, non-exclusive right and license to use such user content (in part or in whole) in any form, media or technology for the full term of any copyright that may exist in such user content, without payment to you or to any third party.

You agree and acknowledge that any user content you submit may be used, published, reproduced, modified, adapted, edited, translated, derived, incorporated into other works, distributed, sub-licensed and other such use of the user content in part or in whole for other products or services by Custom Media. You represent and warrant to Custom Media that you have the full legal right, power, and authority to grant to Custom Media the license provided herein, that you own or control the complete exhibition and other rights to the user content you submitted for the purposes contemplated in this license.

Copyright ownership. You may not modify, publish, transmit, participate in the transfer or sale, create derivative works, or in any way exploit any of Custom Media’s content in whole or in part. You may download copyrighted material for your personal use only. You may not copy, redistribute, retransmit, publish or use for commercial purposes any material without the express permission of Custom Media and the copyright owner.

In the event of any permitted copying, redistribution or publication of copyrighted material, no changes in or deletion of author attribution, trademark legend or copyright notice shall be made.

If you use Custom Media material with permission, you must provide Custom Media with credit such as Source: Custom Media/GoConnect.com or Reproduced under license from Custom Media/GoConnect.com and provide a functional hyperlink to the GoConnect site if it is technically possible.

You acknowledge that you do not acquire any ownership rights by downloading copyrighted material.

Third party content. Custom Media does not endorse and shall not be held responsible for the accuracy or reliability of any opinion, advice, statement, services, offer, or other information or content expressed or made available on the site by any third party. Custom Media will not be responsible or liable, directly or indirectly, for any loss or damage caused by your use or reliance on information obtained through the site. It is your responsibility to evaluate the accuracy, completeness, or usefulness of any information, opinion, advice, or other content available through the site.

Advertisements and promotions. Custom Media shall not be held liable for loss, damage, or other claims resulting from any business dealings or associations between you and third parties featured in advertisements and promotions run by Custom Media and its sites.

Limitation of liability. The site may offer health, fitness, nutritional, financial and other information; however, such information is designed for educational and informational purposes only. Custom Media is not responsible for any action or inaction on your part based on the information presented on the site. You expressly agree that you are solely responsible for your use of the site and its features. Custom Media does not make any warranty as to the results that may be obtained from the use of the site, or as to the accuracy, reliability, or content of any information, service, or merchandise provided through the site.

In no event shall Custom Media or its present or future parent or affiliated companies be liable to you for any personal injury, property damage, lost profits, loss of data, work loss, device or technology failure, loss of goodwill, or reputation or any form of damages based on any causes of action arising out of the use of the site or any failure or performance or alleged error, omission, interruption, deletion, defect or delay in service, operation, or transmission of the site.

You agree that Custom Media is not liable for any actual or alleged defamatory, offensive, or illegal conduct of other users of the site or any other third party.

Custom Media also disclaims any and all liability of any kind for any unauthorized access to or use of your personal information. By accessing the site, you acknowledge and agree to GoConnect’s disclaimer of any such liability. If you do not agree, you should not access or use the site.

Trademarks. Custom Media and its affiliates own all rights to their logos and trademarks used in connection with the site. All other logos and trademarks appearing on the site are the property of their respective owners.

Miscellaneous. If you access the site from any location, you accept full responsibility for compliance with all local laws. You are also subject to Japanese regulations. Custom Media will be in no way liable to the user for any delay or failure in performance, which is due to acts of God, strike, or other official or unofficial labor dispute, union action, or any other cause outside its reasonable control, including (without limitation) directives from the Japanese government or regulatory bodies.
